Abstract
AI and Big Data represent a great potential in nearly all spheres of human life, transforming our approaches to the tasks arising in the practical and scientific fields. This is in particular true for healthcare, as AI is becoming widely used for medical treatment, healthcare research and in the global health market. However, the use of AI and Big Data in the area of healthcare poses new questions to society that need to be accommodated within the legal, economic, and ethical frameworks. This chapter addresses the challenges from a data protection point of view and analyses the legislative measures proposed in response to the technological advancements. With the EU being at the centre of the research, the chapter also considers how other jurisdictions react to AI and health data in an attempt to arrive at a balanced solution for the use of AI in healthcare.
