Ethical Considerations in the Use of Artificial Intelligence in Health Care with Insights from the Indian Context

Abstract
Artificial intelligence (AI) is transforming health care worldwide, including in India, where the healthcare system is beginning to leverage the benefits of AI-driven innovations. From enhancing diagnostic accuracy to improving treatment planning, AI promises to bring significant advancements. However, the ethical challenges that accompany AI’s integration into health care are as pressing in India as they are globally. These challenges, ranging from data privacy to bias in algorithms, require careful consideration to ensure that AI contributes positively to patient care without worsening existing inequities or creating new ethical dilemmas. Patient Privacy and Data Security in the Indian Context India has seen a rapid digitization of health care, driven by initiatives such as the National Digital Health Mission, which aims to create a unified digital health infrastructure. The creation of the Ayushman Bharat Health Account, where patients’ medical records are digitized, is a step toward leveraging AI for better health care. However, this brings a significant challenge, which is ensuring the protection of patient data in a country with evolving data protection laws. The Indian government has introduced the Digital Personal Data Protection Act, 2023, which seeks to safeguard personal data, including sensitive health information. However, concerns persist about whether the current legal framework is robust enough to handle the challenges posed by AI. For instance, AI systems in health care often require vast datasets, and in a country as diverse as India, managing and protecting such data become even more complex. There is also concern that data anonymization, which is widely used to protect patient identities, may not be sufficient given AI's ability to reidentify individuals from seemingly deidentified data. Ensuring that AI systems in India comply with data protection regulations while respecting patient confidentiality is critical. This includes transparent data governance frameworks that allow patients to control how their data are used and ensuring that AI-driven systems are subject to strict regulatory oversight. Furthermore, securing rural healthcare data, where many AI applications are being piloted, is crucial to prevent exploitation or breaches.[1,2] Bias and Fairness in Artificial Intelligence Algorithms in India India’s diverse population presents a unique challenge when it comes to developing AI algorithms for health care. AI systems often rely on training data that may not be representative of the entire population, leading to biased outcomes. For instance, AI models trained on urban healthcare data may not be applicable to rural populations, where healthcare infrastructure and disease prevalence differ significantly. An example of this is in AI-driven diagnostic tools, such as those used for radiology or dermatology. If the datasets used to train these systems primarily consist of images from fair-skinned individuals, they may perform poorly when diagnosing conditions in darker-skinned patients, who are prevalent in India. A 2021 study published in the Lancet highlighted this issue, noting that AI systems trained primarily on Western populations often fail to accurately diagnose diseases in nonwestern populations, including India. Moreover, healthcare inequality remains a significant issue in India, with stark contrasts between rural and urban healthcare facilities. Bias in AI algorithms could inadvertently reinforce these disparities. AI systems need to be trained on data that reflect India’s varied demographic makeup, considering factors such as socioeconomic status, geographical location, and access to health care. Without this diversity in training data, AI could disproportionately benefit certain groups while leaving marginalized populations behind. To mitigate bias, Indian healthcare AI developers must prioritize diversity in their datasets. Initiatives such as creating national healthcare databases that include data from various regions, ethnic groups, and healthcare settings can ensure that AI systems perform equitably across different patient populations.[3,4] Transparency and Accountability in Artificial Intelligence Deployment in Indian Health Care Transparency in AI decision-making remains a critical issue in India’s healthcare ecosystem. AI systems used in hospitals and clinics must be interpretable by healthcare professionals and understandable to patients. However, many AI-driven solutions being piloted in India’s healthcare system are opaque, creating challenges in ensuring accountability when errors occur. For example, AI is increasingly being used in India’s public health initiatives to predict disease outbreaks, improve maternal healthcare, and optimize healthcare delivery in rural areas. However, when these systems make errors, such as failing to accurately predict a disease outbreak or incorrectly diagnosing a patient, there is often little transparency regarding the reasons for these mistakes. This lack of explainability undermines trust in AI, especially in rural or underserved areas where technology adoption is still in its early stages. To address this, the Indian healthcare system must prioritize the development of explainable AI that provides clear, interpretable decisions. This will allow healthcare providers to validate AI-generated recommendations and maintain accountability. In addition, regulatory bodies such as the Indian Council of Medical Research and the Medical Council of India must establish guidelines for the ethical deployment of AI in health care, ensuring that when AI systems fail, there are clear mechanisms for redress and accountability.[5,6] Informed Consent and Patient Autonomy in India Informed consent is a key ethical issue globally, and this holds particularly true in India, where literacy rates and access to information vary widely across the population. Many AI-driven healthcare interventions in India are implemented in rural areas, where patients may have limited understanding of how AI systems work or how their data are being used. A 2020 survey conducted by the Indian Journal of Medical Ethics revealed that many patients in rural India were unaware that AI was being used in their diagnosis or treatment, raising concerns about informed consent. For AI to be ethically integrated into India’s healthcare system, healthcare providers must ensure that patients understand how AI is influencing their care. This includes clear communication in local languages, ensuring that patients are aware of the risks and benefits of AI-driven decisions, and giving them the option to opt out of AI interventions if they so choose. In addition, healthcare professionals in India must be trained to explain AI’s role in patient care effectively. Informed consent forms should be simplified and translated into regional languages to cater to India’s diverse population, ensuring that all patients, regardless of their education level, can make informed decisions about their health care.[7,8] Impact on the Doctor–Patient Relationship in the Indian Healthcare System India’s healthcare system is unique in its reliance on both modern medicine and traditional practices such as Ayurveda and homeopathy. As AI becomes more integrated into mainstream health care, there is concern that it could disrupt the delicate balance between modern medical practices and the personal connection that is central to patient care in India. In many parts of India, particularly in rural areas, patients rely heavily on the personal relationship that they have with their doctors. This relationship is built on trust, communication, and empathy, qualities that AI cannot replicate. The growing use of AI in diagnostics and treatment planning could risk depersonalizing healthcare, particularly in urban hospitals that are becoming increasingly reliant on technology. To prevent this, India’s healthcare system must adopt AI in a way that complements, rather than replaces, the doctor–patient relationship. AI should serve as a tool to assist doctors in making more accurate diagnoses or optimizing treatment plans, but the final decisions should still be made by human healthcare professionals who can consider the patient’s unique circumstances, values, and preferences.[9,10] Conclusion The ethical considerations of using AI in health care are just as relevant in India as they are globally, but they take on unique dimensions in the Indian context. Ensuring that AI is used responsibly in India’s healthcare system requires addressing issues such as data privacy and security, algorithmic bias, transparency, and the preservation of informed consent and the doctor–patient relationship. As AI continues to evolve, India has the opportunity to lead the way in developing ethical, inclusive, and patient-centered AI solutions that reflect the diversity and complexity of its population. The ethical deployment of AI in India must be guided by a commitment to equity, transparency, and accountability. With the right safeguards in place, AI has the potential to transform health care in India, bringing significant benefits to patients across the country. However, this transformation must be driven by ethical principles that ensure AI serves all Indians, particularly the most vulnerable, rather than deepening existing disparities.
