Abstract
The integration of Artificial Intelligence (AI) in medical devices has transformed healthcare delivery, promising enhanced diagnostics, treatment precision, and patient outcomes. However, these advancements invite significant regulatory oversight, especially around data privacy and patient safety. This article explores and compares the key data privacy protection laws impacting AI medical devices in five major jurisdictions: United States (US), European Union (EU), China, Japan, and India. This article compares key data privacy protection laws affecting AI medical devices in five jurisdictions: United States (HIPAA, FDA), European Union (GDPR, MDR, AI Act), China (PIPL, NMPA), Japan (APPI, PMD Act), and India (DPDP Act). It analyses consent, clinical validation, post-market monitoring, cross-border data, and regulatory challenges, highlighting both convergence and divergence in global approaches. Critical insights on compliance hurdles and innovation balance provide a foundation for harmonized international standards and future policymaking.
