Abstract
This study analyzes the legal challenges of informed consent in digital medicine, focusing on the civil and criminal liability of physicians in diagnoses mediated by artificial intelligence. The research investigates how the incorporation of automated decision-making systems into clinical practice changes the content and scope of the physician's duty to inform the patient, as well as the repercussions of this transformation on liability regimes. The investigation adopts a qualitative bibliographic and documentary approach, based on the analysis of indexed scientific articles, specialized doctrinal works, current legislation and resolutions of the Federal Council of Medicine. The results indicate that the use of artificial intelligence in medicine requires the reformulation of informed consent forms, including information about algorithms used, error margins and technical limitations. The study concludes that the protection of patient rights in digital medicine demands specific regulation that articulates algorithmic transparency, qualified human supervision and effective accountability mechanisms.
